Terms of service

These terms govern your use of tusko.ca and the Tusko platform, provided by [legal entity name] ("Tusko", "we", "us"). By using the website or the platform, you agree to them. If you use Tusko for a practice or lab, you confirm you have authority to accept these terms for that business.

If your business has signed an order form or customer agreement with us, that document applies, and it takes priority over these terms where the two differ.

1. Who can use Tusko

Tusko is for dental practices, dental labs and the people who work with them. You must be at least the age of majority where you live and use Tusko for business purposes.

2. Your account

Keep your login details private and make sure everyone on your team uses their own login. You are responsible for activity under your account. Tell us right away at [email protected] if you think someone has accessed your account without permission.

3. Your data and patient information

  • You own the information you put into Tusko, including cases, files and messages ("Customer Data").
  • You give us permission to host, process and transmit Customer Data only as needed to provide, secure and support the service, and as described in our privacy policy.
  • You are responsible for having the right to share Customer Data with us and with the practices or labs you work with, including any patient consent your professional obligations require.
  • You can export your cases. When you leave, we delete your Customer Data on request once any legal obligation to keep it has passed.

4. Clinical responsibility

Tusko is a communication and case management tool. It does not give clinical advice and does not replace professional judgment. Every clinical and laboratory decision, including prescriptions, materials, design and fit, stays with the licensed professionals involved.

5. Acceptable use

Do not:

  • break the law or professional rules while using Tusko;
  • upload anything you have no right to share, or anything malicious;
  • try to access accounts, cases or systems that are not yours;
  • copy, resell or reverse engineer the platform, or use it to build a competing product;
  • overload, probe or disrupt the service.

We may suspend access that puts the service, our customers or patient information at risk. We will tell you why unless the law or an urgent risk prevents it.

6. Free trials and early access offers

Free trials and early access terms, including early access pricing, are set out in your quote or order form. A trial ends on the date stated there. If you don't continue after a trial, you owe nothing for the trial period.

7. Fees

Fees, billing frequency and payment terms are set out in your quote or order form. Fees are in Canadian dollars and exclude applicable taxes such as GST and PST, which we add where required.

8. Third-party services

Tusko works alongside tools from other companies, such as intraoral scanners and scheduling tools. Their terms govern your use of them, and we are not responsible for how they work.

9. Our intellectual property

Tusko, its software, design and content belong to us or our licensors. These terms give you a right to use the service, not ownership of it. If you send us feedback or ideas, we may use them without any obligation to you.

10. Confidentiality

Each of us will protect the other's confidential information with reasonable care and use it only for the purposes of our relationship.

11. Availability and changes

We work to keep Tusko available and secure, but we can't promise it will be uninterrupted or error-free. We improve the platform over time and may change features. If we remove something your business relies on, we will give reasonable notice.

12. Ending your use

You can stop using Tusko at any time, subject to your order form. We may suspend or end access if you materially break these terms and don't fix it within a reasonable time after we tell you, or immediately where the law requires it.

13. Disclaimers

Apart from what these terms or your order form say, Tusko is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

14. Limitation of liability

To the extent the law allows, neither of us is liable for indirect, incidental, special or consequential losses, or for lost profits or revenue. Our total liability for any claim relating to Tusko is limited to the fees you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

15. Indemnity

You will defend and compensate us for claims arising from Customer Data you had no right to share, or from your breach of section 5.

16. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction.

17. Changes to these terms

We may update these terms. The date at the top shows the latest version. For significant changes, we will tell customers in advance by email or in the product. Using Tusko after changes take effect means you accept them.
